Termination of employment

Labor law is extremely important for employers and workers. For this reason, we pay special attention to labor law, labor law counseling and representation of our clients in labor disputes in courts in Bosnia and Herzegovina, in order to protect the interests of both the employer and the worker.

In cases in which the labor law attorney in Sarajevo represented the defendant in court proceedings related to the annulment of the decision terminating their employment, the Municipal Court in Sarajevo, in case number 65 0 Rs 613264 16 Rs of 6 December 2018, rejected the motion in which the plaintiff requested that the defendant’s employment termination decision be annulled as unlawful, and that the defendant be ordered to restore the plaintiff to work and to recognize all his rights under the employment contract, as unfounded. On 8 September 2022, the Cantonal Court in Sarajevo upheld the judgment of the first instance court in case number 65 0 Rs 613264 19 Rsž and ordered the plaintiff to reimburse the costs of the civil proceedings to the defendant.

An identical outcome was recorded in labor disputes concerning annulment of employment termination decisions in the judgment of the Municipal Court in Sarajevo of 26 March 2019, case number 65 0 Rs 613265 16 Rs, which was upheld by the Cantonal Court in Sarajevo on 22 March 2023 in case number 65 0 Rs 613265 19 Rsž, and in the judgment of the Municipal Court in Sarajevo of 14 December 2017, case number 65 0 Rs 609902 16 Rs, which was upheld by the Cantonal Court in Sarajevo on 12 October 2022 in case number 65 0 Rs 609902 18 Rsž.

In all three cases mentioned above, none of the employees/plaintiffs succeeded in their motions to annul the defendant’s employment termination decision as unlawful and to order the defendant to restore the plaintiffs to their jobs and recognize all their rights under the employment contract, because the defendant undertook all actions to fully comply with the legally prescribed employment termination procedure from the very start.
