Copyright

According to the Law on Copyright and Related Rights, copyright and related rights include the right of authors to their literary, scientific and artistic work (copyright), the rights of performers, producers of phonograms, film producers, broadcasting organizations, publishers and producers of databases on their performances, phonograms, videograms, shows and databases.

Copyright covers: written works (literary texts, studies, manuals, articles and other writings, as well as computer programs), oral works (speeches, lectures, sermons and other work of the same nature), dramas, musical dramas and puppetry works, choreographies and pantomimes, musical works with or without words, audiovisual works (film works and works created in a manner similar to film creation), works of fine arts (drawings, paintings, graphics, sculptures and other works of the same nature), architectural works (sketches, plans, drawings and constructed objects), works of all branches of applied arts, graphic and industrial design, photography and works produced by means similar to photography, cartographic works and presentations – scientific, educational or technical in nature.

The author of the work is the natural person who created the work. Copyright lasts for the life of the author and 70 years after his/her death. Copyrights are inheritable.

Law Office Rašid Haračić represents clients in copyright proceedings, in cases where the copyright is jeopardised or used by others. A person whose copyright was infringed may seek protection of those rights and compensation pursuant to general damage compensation rules. The same protection can be sought by a person exposed to a real threat of infringement of his/her rights.

For our clients, we initiate a copyright lawsuit, in which we request:

  • Verification of the committed copyright infringement;
  • Prohibition of further infringement and similar future infringements by abstaining or desisting from any actions that may infringe this right;
  • Elimination of the situation arising from the infringement;
  • Withdrawal of infringing objects from the market, with due regard for interests of
  • conscientious third parties;
  • Total withdrawal of infringing objects from the market;
  • Destruction of the infringing object;
  • Destruction of instruments exclusively or predominantly intended or used for

the purposes of infringement which are the property of the infringing party;

  • Handing over the infringing object to the copyright holder with payment of production costs;
  • Announcing the verdict.
