Competition law

Competition law is a young branch of law in Bosnia and Herzegovina, meaning that many market participants are not familiar with their rights and obligations arising from the Law on Competition of Bosnia and Herzegovina. This law regulates the rules, actions and procedures for the protection of market competition, as well as the competences and operation of the Competition Council in the area of protection and promotion of market competition in Bosnia and Herzegovina.

These legal provisions apply to all legal and natural persons directly or indirectly engaged in production, sale of goods or provision of services that may obstruct, restrict or distort market competition in the entire territory of Bosnia and Herzegovina or affect a substantial portion of the market.

Competition law and commercial law include unavoidable regulations that are crucial for market companies, which is why our office pays special attention to this body of law through continuous focus and daily improvement. Local markets are increasingly becoming subject to global challenges and therefore require expertise and knowledge, specifically with regard to national legislation which is gradually approximating the EU Directives.

If you have been present on the market for a long time, this does not necessarily mean that you will not be exposed to regulatory risks related to competition or illegal market influence by dominant market actors.

If you are new to the market, you must bear in mind that the emergence of a new company on the market requires some form of protection against exploitative/exclusive markets dominated by large companies or other market actors.
