Criminal law in economy

One of the greatest challenges today is the detection and prosecution of economic crime, handled in Bosnia and Herzegovina by entity-level and national agencies and by entity Prosecutors' Offices, the Prosecutor's Office of Brčko District of BiH and the Prosecutor's Office of BiH, as well as courts at all levels.

Compared to the classic forms of crime, economic crime is the most complex form of crime in terms of detection, proof and prosecution, so proving economic crime, general or organised, is a very long, complex and painstaking task that requires maximum engagement on your part. Why is that?

Economic crime is the most complex form of crime to investigate and prove, because, first of all, it is difficult to detect, and after detection it requires a wide range of activities by many participants in the investigation and evidence-gathering process.

Our office activities in this area are particularly focused on commercial crime, including certain criminal offenses known as white-collar crime, perpetrated by persons in the company authorised to, based on their position or special authorisation, perform certain tasks related to compliance with laws, bylaws or general acts of the company or another legal person in the domain of management and handling of assets or other economic processes, or supervision over them (embezzlement).

Our area of expertise includes:

  • Fiscalization offences (direct and indirect taxation);
  • Market competition offences (violation of equality in business operations, monopolisation and unfair market competition, etc.);
  • Bankruptcy and privatization offences (bankruptcy abuse, abuse of bankruptcy proceedings, false bankruptcies, abuse in privatisation processes);
  • Business crime (negligent business operations, abuse of authority in business operations, entry into harmful contracts, disclosure and unauthorised acquisition of confidential information);

Due to their complexity, detection of such crimes requires dedicated effort and full analysis of all facts, as well as a planned, systematic and organised approach.
