Succession proceedings take place every day and create the need for a highly professional approach and familiarity with one's rights. Succession rights are acquired at the moment of the deceased's death. Succession proceedings are initiated ex officio, not more than 30 days after the court receives the death certificate or the excerpt from the register of deaths. Succession proceedings identify the heirs of the deceased, what constitutes the estate and other rights to the estate that belong to the heirs, legatees and other persons.

The heirs inherit by the order of succession. The first order of succession is the spouse/civil partner and children, who inherit equal shares. Before the division of the estate, different situations such as the existence of matrimonial property, lifelong support contract or a will may alter the course of the succession proceeding. In inheritance matters, extramarital kinship is equal to marital kinship and full adoption is equal to kinship by blood.
