After the completion of construction, the investor is obligated to submit a request for a technical inspection and issuance of an occupancy permit. It is determined whether the building has been constructed in accordance with the approved construction permit and the approved technical documentation, allowing it to be used.
The occupancy permit is a decision of the competent authority establishing that the facility has been built in accordance with the construction permit, approving the use of completed works. The occupancy permit guarantees compliance with all necessary and mandatory construction rules, equipment verification, functionality, connection to the entire infrastructure network, and approvals from relevant authorities and institutions. In other words, obtaining an occupancy permit means that the facility is suitable for use.
The issuance of an occupancy permit is preceded by a technical inspection of the facility, conducted upon completion of construction. The technical inspection includes verifying the compliance of completed works with the construction permit and technical documentation based on which the facility was constructed, as well as with technical regulations and standards related to specific types of works or construction products, equipment, and facilities. A positive report from the technical inspection is essential for obtaining the occupancy permit. Only after obtaining the occupancy permit can the property be registered. Therefore, without an occupancy permit, it is not possible to register the property and individual units within the building.
The commission conducted the technical inspection in two parts: a visual inspection of completed works and a review of attestations and other technical documentation. The commission met on-site in full on January 21st, 2023, raised a few minor objections, and instructed the investor to address these objections and deficiencies within a specified timeframe. After the identified deficiencies were addressed, the investor informed the commission. On April 30, 2023, the commission conducted a re-inspection and confirmed that the objections and deficiencies identified during the re-inspection had been resolved. The commission submitted a Report on the performed actions in inspecting the facility to the Department for Geodetic and Property-Legal Affairs, Cadastre, Spatial Planning, and Communal Activities on May 15, 2023. The report, signed by all commission members, stated that, in their opinion, an occupancy permit could be issued for the inspected facility.
The Municipal Department for Geodetic and Property-Legal Affairs, Cadastre, Spatial Planning, and Communal Activities, in response to the investor’s request for a technical inspection of completed works and an occupancy permit, based on Article 129, paragraph 1, and Article 134, paragraph 1, and Article 138, paragraph 1, of the Law on Spatial Planning and Construction of the Bosnian-Podrinje Canton Goražde, and Article 200 of the Law on Administrative Procedure, issued Decision No. 04-19-121-7/22 on February 23rdt, 2023. The decision allows the investor to use the electrical power facility.
