In the event of divorce, a spouse may acquire the right to receive support from the other spouse under the following conditions, all of which must be fulfilled:
- The spouse does not have sufficient means of subsistence or cannot obtain them from their own assets
- The spouse is incapable of working or cannot find employment
- The other spouse has the financial means to provide support.
A request for spousal support may be submitted no later than the conclusion of the main hearing in the divorce proceedings, and exceptionally within one year from the date of divorce.
The court may reject the request for spousal support if the applicant seriously or indecently behaved in the marital union without justified reason, or if the obligation to provide support would represent a clear injustice for the other spouse.
The right to spousal support ceases if the supported divorced spouse enters into a new marriage or establishes an extramarital union with another person.
