Establishing a citizens’ association in Bosnia and Herzegovina allows a group of individuals to formally act in the public interest, promoting ideas, initiatives, and projects in various fields – from education and culture to human rights and environmental protection. In practice, one of the most common questions and dilemmas founders face is where to register the association – at the cantonal or state level?
Associations that intend to operate exclusively within the territory of Sarajevo Canton are registered with the Ministry of Justice and Administration of Sarajevo Canton.
Key features:
- Competent authority: Ministry of Justice and Administration of Sarajevo Canton
- Territorial scope: Activities limited to Sarajevo Canton
- Registration timeframe: On average, 15–30 days
- Required documents: Statute, founding act, minutes from the founding assembly, information about the founders
- Registration costs: Lower than at the state level
Registration at the cantonal level is suitable for local initiatives and projects, as well as cultural, sports, and youth organizations with a local focus.
If the association intends to operate across multiple entities or throughout the entire country, registration is carried out at the state level, with the Ministry of Justice of Bosnia and Herzegovina.
Key features:
- Competent authority: Ministry of Justice of Bosnia and Herzegovina
- Territorial scope: Entire territory of Bosnia and Herzegovina
- Registration timeframe: Typically 30–60 days
- Required documents: Similar to those required at the cantonal level, but with additional verification steps
- Registration costs: Higher compared to the cantonal level
Registration at the state level is suitable for inter-entity or international activities, as well as associations headquartered in Sarajevo or other municipalities, but operating across the country.
What to keep in mind when establishing an association:
- The statute must comply with the Law on Associations and Foundations (either at the state or cantonal level, depending on where you register).
- Minimum number of founders: three individuals.
- The association’s name must not be identical or confusingly similar to an already registered one.
