In certain cases, the creditor secures his claim by establishing and registering a mortgage over the real estate of the debtor.
If the debtor, for any reason, fails to repay the debt as agreed with the creditor, the creditor may, on the basis of a previously registered mortgage, initiate an enforcement procedure over the real estate of the debtor in order to settle his claim.
Real estate enforcement is carried out by recording the enforcement in the land registry, real estate valuation, the sale of the real estate, and settling the judgment creditor’s claim from the proceeds of the sale.
In a case where this office represented the judgment creditor in Debt collection in Bosnia and Herzegovina (Inkasso in Bosnien und Herzegowina) – enforcement over real estate property –, on 9 June, 2020, the Municipal Court in Široki Brijeg, in the case number 64 0 I 053982 20, issued an Enforcement Decision ordering enforcement over the judgment debtor’s real estate on account of the judgment debtor’s debt in the amount of BAM 107,565.85 (EUR 54,997.54).
With the Enforcement Decision, an enforcement record was made in the land registry, which prevented the debtor from further disposing of the real estate / immovable property, and the valuation of the immovable property was done by a court expert. After valuation of the real estate, the court organized public sales of the real estate in order to pay the judgement creditor from the proceeds of the sale.
We also represented a judgement creditor before the Municipal Court in Bugojno, case number 46 0 and 094849 19 I, regarding a debt in the amount of BAM 72,337.93 (EUR 36,985.79), where we initiated the enforcement procedure at the Municipal Court in Sarajevo, 65 0 Ip 905452 21 Ip of 1 July, 2021, due to debt in the amount of BAM 707,334.09 (EUR 361,654.17). In both of these cases, judgement creditors reached a settlement concerning the claim for which they initiated the enforcement procedure.
