Water permit for the use and utilization of facilities in Bosnia and Herzegovina

Obtaining a water permit is an essential part of the process of issuing urban, construction, usage, environmental permits, and concession allocations. The procedure for issuing water acts generally follows a specific order. Water acts are initially issued as “preliminary water consent,” which is granted before the preparation of investment-technical documentation for activities and facilities that, according to water law, require obtaining water acts. This consent precedes the issuance of environmental permits, urban planning approvals, and in the process of granting concessions for water and water assets.

Furthermore, it is necessary to obtain “water consent,” which is issued after the preparation of investment-technical documentation in accordance with the conditions specified in the preliminary water consent. This step precedes the commencement of construction of new or reconstruction of existing facilities or the execution of certain works that may affect the water regime, and it precedes the issuance of building permits in accordance with spatial planning regulations.

Finally, the “water permit” is issued before the approval for the use of the facility according to spatial planning regulations. After reviewing the submitted technical documentation, in accordance with Article 12, paragraphs 5 and 6 of the Regulation on the content, form, letters, manner of issuance, and storage of water acts, an inspection was carried out at the business premises by representatives of this ministry, in the presence of the applicant’s representatives, and a report on the inspection at the facilities was drawn up.

The Ministry of Economy of the Bosnian-Podrinje Canton Goražde, in response to the request of the economic company represented by this office for the issuance of a water permit for the use and utilization of facilities based on Article 42, paragraph 1, point e), and Article 74, paragraph 1, of the Law on Waters of the Bosnian-Podrinje Canton Goražde, and Articles 12, 13, and 17, paragraph 2, point 4 of the Regulation on the content, form, conditions, manner of issuance, and storage of water acts, and Article 200, paragraph 1 of the Administrative Procedure Law, issues Decision on water permit number UP-1:04-21-352/23 of October 20, 2023.

Based on the conducted procedure, it was determined that the client represented by this Office fulfilled the conditions for the issuance of a water permit, as prescribed by Articles 115 to 118 of the Law on Waters and Articles 12 and 13 of the Regulation on the content, form, letters, manner of issuance, and storage of water acts. Therefore, based on Article 42, paragraph 1, point e), and Article 74, paragraph 1 of the Law on Waters of the Bosnian-Podrinje Canton Goražde, it was decided in favor of our client.
